LEGAL
THREAT WON'T DETER RADIO RENTALS PROTEST
14 September 2006
SA Unions
Secretary, Janet Giles says a community protest by Radio Rentals
workers, their families and supporters will proceed as planned,
despite intimidating legal threats by the company.
Ms Giles says
the Company's bullying attitude will only galvanise workers' resolve
to achieve a fair deal.
Yesterday, Radio
Rentals lawyers Minter Ellison sent her a letter trying to deter her
from attending the picket and pointing out that she could be liable
for 6 months jail or a $2,5000 fine if she enters Radio Rentals'
property, including the car park.
"I thought we
lived in a free democratic country, where people who have grievances
about unfair treatment have a right to freely express themselves
without fear of this sort of threat."
"The company is
trying to throw up all sorts of reasons why there ought not be a
protest - public safety, motorist safety, trespass - it is even
threatening to withdraw union right of entry permits."
"Not one of
these reasons constitutes a legitimate concern. We are not
there to cause public harm and we have a right to be on public
property. This is simply an attempt by the company to
intimidate and threaten workers into backing down."
"It follows the
company's extreme decision to lock out for an entire month workers
who took legal, protected industrial action, in what is
simply a starvation tactic to try to get them to cave in to the
company's demands."
"Meanwhile, the
company continues to claim that the new Industrial Laws have no
bearing on its lock out decision, despite knowing full well that the
laws stripped workers of any opportunity to appeal for assistance to
the Industrial Relations Commission."
"Radio Rentals
is fast showing itself to be a company that is prepared to sacrifice
the rights of loyal, long term employees on the altar of profits.
And it can do so knowing workers no longer have any recourse under
the new IR Laws," Ms Giles says.
